Terms of Service
OwnMetrics Joint Tracker
Effective date: 4 November 2026
Last updated: 4 November 2026
Applies to: OwnMetrics Joint Tracker version 3.0.0 and later
1. Agreement
These Terms govern your use of the OwnMetrics Joint Tracker mobile
application ("the App"), provided by Geoffrey Harte ("we", "us").
By downloading or using the App you agree to these Terms. If you do not agree,
please do not use the App.
Your use is also subject to our Privacy Policy,
and to Apple's standard End User Licence Agreement for App Store applications.
2. What the App is
OwnMetrics is a personal symptom diary for people living with joint
conditions. It lets you record daily joint pain, swelling, morning stiffness
and treatment changes, review your own history, and export a report to bring to
a medical appointment.
Everything you record is stored on your device. See the Privacy Policy for
detail.
The App requires an active subscription to use. See section 3.
3. Subscription
3.1 What you're paying for
Access to the App requires an auto-renewing subscription, purchased through
the App Store. Current pricing, billing period(s) and any introductory offer
are shown in the App before you subscribe, and on the App Store listing.
3.2 Free trial
Where offered, a free trial gives you full access to the App for a limited
introductory period (3 days). Unless you
cancel before the trial ends, it converts automatically into a paid
subscription and you will be charged the price shown at the time you
started the trial. You can cancel any time before the trial ends with no
charge, using the method in section 3.5.
3.3 Billing and auto-renewal
Your subscription automatically renews for the same period unless you cancel
at least 24 hours before the end of the current period. Your Apple ID account
is charged for renewal within 24 hours prior to the end of the current
period, at the price you agreed to. Prices may change on renewal; where
required, you will be notified in advance.
3.4 No refunds from us
All payments are processed by Apple through the App Store. We do not process
payments or issue refunds directly. Refund requests are handled by Apple in
accordance with their own policies — see
reportaproblem.apple.com.
3.5 Managing or cancelling your subscription
You can view, change or cancel your subscription at any time in iOS Settings
→ your Apple ID → Subscriptions, or from within the App (Settings → Manage
Subscription). Cancelling stops future renewals; you retain access for the
remainder of the period you've already paid for.
3.6 No partial refunds for unused time
If you cancel partway through a billing period, you keep access until the end
of that period, but we do not provide partial refunds for the unused portion
— consistent with Apple's standard subscription terms.
4. Medical disclaimer — please read
The App is not a medical device.
It is a diary that records what you tell it and shows it back to you. It does
not, and is not intended to:
- diagnose, treat, cure or prevent any disease or condition
- assess, measure or grade disease activity
- provide medical advice, clinical recommendations or treatment decisions
- replace consultation with, examination by, or the judgement of a qualified
healthcare professional - monitor you, or alert anyone, in an emergency
Any summaries, trends, patterns, scores or observations the App displays are
descriptions of the data you entered. They are not clinical findings and
have not been validated as a clinical instrument. They may be incomplete or
misleading if your entries are incomplete, and they cannot account for anything
you did not record.
Always seek the advice of your doctor, rheumatologist or other qualified
healthcare professional with any questions about a medical condition or
treatment. Never disregard professional medical advice, or delay seeking it,
because of something you saw in this App. Never start, stop or change any
medication based on this App.
In a medical emergency, call 112 or 999 immediately. Do not use the App to
seek help in an emergency.
5. Minimum age
You must be at least 16 years old to use the App.
The App is designed for adults managing their own health. If you are under 16,
please do not use it.
6. Your responsibilities
You are responsible for:
- The accuracy of what you enter. The App cannot tell whether an entry is
correct, and any report is only as reliable as the data behind it. - Your own data. Because it is stored only on your device, we cannot
recover it. If you lose, reset or replace your device, or delete the App,
your entries are gone permanently unless included in your own device backup.
Export your data periodically if you want to keep it. - Where you send exported reports. Exports contain your health information
and, where you enter them, a patient name and date of birth. Once you share a
file, it is outside our control and outside the App's. - Using the App lawfully and for your own personal, non-commercial use.
7. What you may not do
You may not:
- use the App to provide medical services to another person, or hold its output
out as a clinical assessment - reverse engineer, decompile or attempt to derive the source code, except so
far as applicable law expressly permits - copy, redistribute, resell or sublicense the App
- use the App unlawfully, or in a way that infringes another person's rights
8. Intellectual property
The App, its design, and its content (excluding data you enter) are owned by
Geoffrey Harte and protected by intellectual property law. You are
granted a personal, non-exclusive, non-transferable, revocable licence to use
the App on devices you own or control.
Data you enter remains yours. We claim no rights over it, and in any case
never receive it.
9. Availability and changes
The App is provided as-is. We may update, change or discontinue it, or any of
its features, at any time. Updates may be required for continued operation, and
compatibility with future operating system versions is not guaranteed.
Because your data is stored locally, discontinuation would not delete data
already on your device — but you should keep your own exports of anything you
need to retain.
10. No warranty
To the fullest extent permitted by law, the App is provided "as is" and "as
available", without warranties of any kind, whether express or implied,
including any implied warranties of merchantability, fitness for a particular
purpose, accuracy, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or that any
defect will be corrected.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for:
- any decision made, or not made, about your health, treatment or medication in
reliance on the App - loss of data stored on your device, however caused
- any indirect, incidental, special or consequential loss
- any loss arising from the App being unavailable or not functioning
Nothing in these Terms excludes or limits our liability for death or personal
injury caused by negligence, for fraud or fraudulent misrepresentation, or for
any other liability that cannot lawfully be excluded or limited.
Your statutory rights as a consumer are not affected. If you are a consumer
in the EU/EEA, you retain all rights under applicable consumer protection law,
including your rights regarding auto-renewing subscriptions, and nothing here
overrides them.
12. Termination
You may stop using the App at any time by deleting it, which removes your data
from the device. Deleting the App does not cancel an active subscription —
cancel separately via section 3.5 to stop future charges.
We may terminate this licence if you materially breach these Terms.
13. Changes to these Terms
We may update these Terms. The "last updated" date will change and the current
version will be published at this address. Where changes are significant, we
will surface a notice in the App. Continuing to use the App after a change
means you accept the revised Terms.
14. Governing law and jurisdiction
These Terms are governed by the laws of Ireland.
Disputes are subject to the exclusive jurisdiction of the courts of Ireland,
except that if you are a consumer resident in another EU/EEA member state,
you retain the right to bring proceedings in, and the protection of the
mandatory consumer law of, your country of residence.
EU consumers may also use the European Commission's Online Dispute Resolution
platform: https://ec.europa.eu/consumers/odr
15. General
If any provision of these Terms is found unenforceable, the remainder continues
in effect. Our failure to enforce a provision is not a waiver of it. These
Terms, with the Privacy Policy, are the entire agreement between us regarding
the App.
